We lost an appeal to the Second Circuit of a dismissal of our Federal RICO case last month. We have now updated our complaint and filed suit in New York County Supreme Court (state court) for breach of contract, tort, etc. The complaint has not yet been served, and we see strategic advantage to maintaining the complaint in a low-profile status at this time. We would appreciate it if you would not publicize this message. In the meantime, we have reached out to the Eichers and Hilton/BlueGreen to open settlement discussions. Neither effort has advanced, but discussion with counsel for Hilton/BlueGreen are ongoing. If discissions fail to advance, we will serve the Complaint and proceed with the litigation. EXACTLY - this should NOT have been posted -you listen to Counsel representing you - why did you not do that? Don't you realize that the opposing side monitors sites just like this one????

It has been widely speculated for many years that TMC monitors this thread. Good job Rachelle. Appreciate your input. You might want to circle back with Steve and let him know what you've done. Yes, this was a sarcastic response, but I'm not kidding about letting Steve know.

So looking fro some advice here. My dad passed away last year and just got a call from Manhattan Club looking for $3900 maintenance fees. No one has used the place since 2022. As you all know impossible to book etc,,, I asked about turning in the deed they said that is no longer an option and she cant talk to me until I pay. I am tempted to just ignore them but they have said it will go to collections etc.. Has anyone just ignored them and if so what did they actually do? I don't want to ruin my mothers credit or have liens against her but I don't want to shell out 3900 for a week we will never use. Any advice will be great the lady on phone said I only have 1 week to make a decision before fines and penalties start.

I received the following check from the BBB. Anyone else get this? Would cashing this close out options for additional settlement funds?

On behalf of the New York State Office of the Attorney General, the Better Business Bureau of Metropolitan New York is pleased to enclose your share of the final restitution payment from the settlement with The Manhattan Club and its Principals.

How much was the amount of the check you received and had you been in touch with the BBB earlier - am wondering how they had your address? Also, had you provided any information when the initial lawsuit against the Manhattan Club and its developers had first been filed.

No, I never contacted the BBB. I provided information to Zimmerman when I first joined his (at the time) suit. That is all.

Interestingly, the check was only made out to me and not also to my wife, as we have joint tenancy.

Check is for $323. Not worth the hassles and drama.

I am still looking for advice as to how to proceed.

I would not pay. Personally, I was able to give back two of them for $100 after a couple of years of hell and dealing with several different lawyers that gave bad advice. The Manhattan club was sued years ago by the district attorney of New York the Manhattan club Lost, although not much happened to them and I heard through red week that people who did not pay either had no consequences or if they were reported to a credit bureau the credit bureau would drop the complaint because of the fact that they had been sued and lost. That is because the credit bureau didn’t have a leg to stand on because of the suit. Its just a scare tactic. Don’t pay them and forget about them. I’m so sorry you’re going through this as I did.

Can you give me Attorney Zimmerman's address - I didn't know if it had changed since we first became involved with him and the lawsuit. And do you have any info. like the address or anything else regarding BBB and your check. My address has changed since I many years ago submitted info. to Attorney Zimmerman. I did not receive a check so could be because I do have a different address now.

I've been with John Zimmerman since the inception of our lawsuit since 2018. Just had a wonderful conversation with him & he knows nothing about the check someone received from the BBB. The suit is still ongoing, and the courts are dragging their feet. He's still involved and feels that we can win!! Not sure of the time frame.

Nice to see this thread going and to hear that the lawyer is continuing. I am getting old, though.

I, too, received a check from BBB a couple weeks back for $190. I’ve never had any contact with them in the past. Don’t know why.

I did give information during the initial lawsuit brought by the ATTY GENERAL however. Eichner (I think that’s his name) and family were found guilty and were fined $6 million. Then the ATTY GEN. Was found guilty of abuse and fired, so there was no follow-up. The threads were just left hanging. My recollection of the incident.

I did receive 2 checks from some entity, like for $50 and, months later, another formaybe $100 .

What is his ( Zimmerman's) address? I'm wondering where the B B B got its list of owners from - like a list of owners who had provided info. to Mr. Zimmerman or had been contacted by the previous N. Y. Attorney General?
